ILO/ Better Work Viet Nam - Request for consultancy service

1. Background

Since August 2017, under the framework of the Zero-Tolerant Protocol (ZTP) signed between the Ministry of Labour - Invaids and Social Affairs (MoLISA) and Better Work Global Programme, Better Work Viet Nam (BWV) has been implementing the agreement with MoLISA Labour Inspectorate and Department of Child Affairs regarding the protocol to receive information, provide support and intervention when child workers are found in violation with the law (hereafter called “the child protocol”).

Following the revision of the Labour Code 2019, to update the child protocol with current labour laws and child regulations, and to support enterprises in collaborating more efficiently with the local authorities in implementing this protocol, Better Work Viet Nam is looking for consultant(s) to review the implementation of the protocol and update it following the latest laws and regulations. The consultant(s) will also review the protocol to better share information and facilitate collaboration mechanism to reflect the reality with respective functions, and responsibilities of relevant parties. At the same time, the consultant(s) will support Better Work Viet Nam in working with the Child Department to strengthen the communication and improve the awareness in the prevention of child labour in the supply chain and to strengthen child protection education for female workers in post-Covid periods.

Objectives:

  • Review and update the child protocol following the latest laws and regulations.
  • Review and facilitate discussions to agree on the collaboration mechanism at the national and local level in implementing the protocol.
  • Strengthen the capacity of BWV enterprise advisors in providing advisory service for enterprises to identify and prevent child labour at the workplace through training on the implementation of the child protocol.
  • Improve the awareness in the prevention of child labour in the supply chain.
  • Strengthen child protection, care and education (in particular migrant children with their working mothers).

Expected outcomes:

  • The child protocol is updated to the law and implemented at the national and local level with clear roles and responsibilities and collaboration mechanism.
  • BWV enterprise advisors understand the updated protocol, know how to follow it in their factory work, and improve advisory skills on child labour prevention and young labour management at the enterprise.
  • BWV participating enterprises improve the awareness in the prevention of child labour in the supply chain.
  • Relevant targeted audience improve their understanding of early childhood care and adapt into their work.

2. Tasks and Deliverables of the consultant(s)

  • Conduct desk review of the child protocol and update it with relevant legal requirements.
  • Facilitate a meeting/workshop to agree on the collaboration mechanism with the Labour Inspectorate and local authorities when implementing the protocol.
  • Conduct one-day training for BWV enterprise advisors to update the protocol and improve their capacity in providing advisory service for enterprises to identify and prevent child labour at the workplace.
  • Facilitate Industrial Seminars on “Prevention of child labour and young labour management” for BWV participating factories (including promotion of Child Labour CoC developed under the scope of ILO-ENHANCE project).
  • Improve communication and conduct trainings on child protection, care and education for female workers through GOPY mobile app.

Additional terms:

  • Protect the Better Work materials as intellectual property and do not transfer the materials in any form (hard copy and soft copy) to any third party.
  • Respect and follow Better Work communication guidelines, especially using consistent image of Better Work, precisely using Better Work brand name, logos, promotional materials and introduction information.

3. Timeline

This work will be started in September 2023 and completed and delivered not later than December 2023.

4. Reporting

The consultant(s) will work closely with a focal Enterprise Advisor and report the progress to Better Work Viet Nam’s National Operations Manager.

5. Criteria for selecting the consultant team (referred to as “Consultants”):

The consultant(s) is/are expected to acquire the following qualifications:

  • Minimum university degrees in social science and humanity, development, economics, labour, or relevant subjects.
  • Having at least 5 years’ experience in conducting similar activities as specified in this term of reference.
  • Having experience working with international organizations including UN agencies

6. Consultancy fee and payment terms:

  • Consulting fees: as per agreement and in accordance with the consultant(s)’s qualification/experience and the latest UN – EU cost norm for national consultant rate.
  • The consulting fee will be paid in accordance to completed deliverables. No advance payment except for travel expenses if any are payable.

7. Application:

  • Proposed budget (calculated on a daily basis), including taxes and all-inclusive costs necessary for the consultancy (consulting fee, travel expenses, per diem, accommodation during the assignment).
