International Consultant to Provide Service as Resource Person in VBF’s International Workshop on Rights of Defense Lawyers in Criminal Procedure Code

The UNDP Viet Nam seeks one (01) International consultant to provide service as Resource Person in VBF’s international workshop on rights of defense lawyers in criminal procedure code.

The Criminal Procedure Code was promulgated in 2003. Through 7 years of implementation, shortcomings arisen. Therefore, in the Law and Ordinance making program 2012 of the National Assembly, the Code is planned to be revised.
Under the duties and functions of a socio – professional organization of lawyers, Viet Nam Bar Federation (VBF) has responsibilities to evaluate the current status of the Criminal Procedure Code implementation on the aspect of ensuring the right to counsel of lawyer and advocators in the criminal procedure.
VBF and the local bar association however have not compiled and evaluated the current status of ensuring the right to counsel of the detained and offended person and the right of the advocators when participate in the criminal procedure (generally mentioned to as the right to counsel). There are some survey reports on the protection of lawyers during practice with the support from the international organization and presentation paper in some judicial science workshop on the obstacles and challenges of the advocators when participate in the criminal litigation process in different stages.
On that basis, VBF will organize an International Workshop on Criminal Procedure Code 2003 and Right of Defense Lawyers to create a forum for international and national participants to discuss and exchange the experience on the implementation status and the legal framework on ensuring the right to counsel in criminal procedure and propose the recommendations for the revision of the Code.  UNDP will together with other international partners (JPP, JICA, and Germany) to support VBF with international experts to be resource persons at the Workshop. VBF has requested UNDP to support to provide an international expert with the knowledge on Rights of Defense Lawyers in Criminal Procedure of the Russia Federation.

An international consultant working as a resource person will be required to:
- Provide the experience and actual implementation and the current rules of the Russia Federation on ensuring the right to counsel and the right of lawyers in the criminal procedure
- Research the Criminal Procedure Code of Vietnam and materials provided by Vietnamese side to compare and evaluate the pros and cons of the Russia Federation and provide recommendations and supplements on the concrete regulation under the Viet Nam’s Code.

The selection will be based on a competitive basis and will comply with UNDP procurement regulations.
