1. CONTEXT

The Hanns Seidel Foundation is a political foundation with its headquarters in Munich (Germany). “In the service of democracy, peace and development” – this motto is present in the work and mission of the Hanns Seidel Foundation. This motto applies both to its activities in Germany and abroad. Since 1995, HSF had supported the integration of Vietnam into the global political spectrum and the ASEAN-Community. Since the establishment of a representative office in 2011, HSF has focused its work in Vietnam on social and environmental policies for sustainable development.

HSF has agreed to support the Department of Legal Affairs of the Ministry of Natural Resources and Environment (MoNRE) of the Socialist Republic of Vietnam in the context of conducting research on Best-Available-Techniques: applicability in Vietnam and approach for the revised Law on Environment Protection.

Currently the Law on Environmental Protection (LEP) of 2014 is undergoing a revision process with the first draft published in December 2019 by MoNRE to seek inputs and comments from various stakeholders and society. One of the innovative additions to the revised LEP is the application of a Best-Available-Techniques (BAT) approach. As BAT is a new approach in Vietnam, MoNRE and HSF have agreed to jointly identify TWO suitable Consultants to conduct research focusing on the following objective(s) and with the following deliverables.

2. OBJECTIVE(S)

Through, this ToR TWO Consultants are to be identified: ONE Senior Expert and ONE Junior Researcher.

The Consultants will conduct research on international experiences on BAT, its applicability in Vietnam and will propose a suitable BAT approach for the revised Law on Environmental Protection 2020 as well as an application roadmap for the time period after the the law has been adopted.

3. DELIVERABLES

  • A draft research report with the following main contents. The final structure and contents of the report will be discussed further among consultant(s), MoNRE and HSF and is specifically subject to the articulated needs of MoNRE. The report will be in Vietnamese and English with an Executive Summary in English.
    Part 1: BAT concept
    • General BAT concept
    • International experience on BAT adoption, reviewing lessons learned from approaches being taken by different countries to develop and implement BAT, especially those involved in the OECD BAT project such as Chile, European Union, Finland, France, Germany, Israel, New Zealand, Sweden, United Kingdom, Armenia, Brazil, India, Kazakhstan, Peoples Republic of China, Russian Federation, USA, and Korea, assisted by UNIDO and other agencies.
    • Experiences of potentially existing BAT projects in Vietnam

    Part 2: BAT applicability in Vietnam

    • Assessment of the impact of BAT on the other environmental protection measures, such as but not limited to environmental impact assessment, environmental permits, environmental standards, inspection and examination.

    Part 3: Policy recommendations

    • Recommendations on the approach to include BAT in the revised Law on Environmental Protection
    • Recommendations of steps to be taken after the adoption of BAT in the revised Law on Environmental Protection

  • Report of the consultative workshop(s) with overview of inputs and discussions
  • A final research report which incorporates the inputs and comments from the consultative workshops

 4. SPECIFIC TASKS

In close direction and coordination with the Department for Legal Affairs, Ministry of Natural Resources and Environment, the Consultants will execute the following tasks:

  • Conduct desk research on the concept of BAT and international experience in applying BAT, review existing BAT models in Vietnam
  • Analyze the impact of BAT other environmental protection measures
  • Assess the impact of BAT approach in the draft revised Law on Environmental Protection (provided by DLA) on industries, including surveys and interviews where applicable and necessary;
  • Support DLA to prepare the presentation for and present at Consultative Workshops, consolidate the comments and inputs for finalizing the report.
  • Liaise and coordinate closely with HSF and Department of Legal Affairs, respond to questions and comments by HSF and DLA in a timely manner

6. QUALIFICATION AND EXPERIENCE REQUIREMENTS

(a) Senior Expert

  • Have at least a master degree in economics, laws, natural resource management, environment or related fields;
  • Have at least 15 years of experience in a field related to industrial environment, environment engineering and/or other relevant fields
  • Have knowledge and understanding of environment permits and standards, environmental impact assessment as well as other environmental protection measures
  • Working experience with MoNRE and/or MoIT and contact with industry stakeholders is a plus
  • Excellent analytic skills, demonstrated report writing and presentation skills in both English and Vietnamese.

(b) Junior researcher

  • Have at least a bachelor degree in economics, laws, natural resource management, environment or related fields;
  • Have at least 5 years of experience in a field related to industrial environment, environment engineering and other relevant fields
  • Have knowledge and understanding environment permits and standards, environmental impact assessment as well as other environmental protection measures
  • Working experience with MoNRE and/or MoIT and contact with industry stakeholders is a plus
  • Excellent analytic skills, demonstrated report writing and presentation skills in both English and Vietnamese.
