RFQ: Advise and Support on Legal Requirements for a German NGO

1. BACKGROUND

The German Cooperative & Raiffeisen Confederation (DGRV) in Vietnam supports the establishment of a market-oriented cooperative system using a multi-level approach. In addition to supporting agricultural cooperatives and savings and credit cooperatives at the micro-level, the development of cooperative unions and alliance structures is an important approach as well. While Vietnam Cooperative Alliance (VCA) is a national department and a kind of umbrella alliance, every province has their own province cooperative association (PCA). At the national level, DGRV supports state institutions with the creation and further development of necessary legal and regulatory framework conditions. One of DGRV's focus areas in this project is supporting the institutional setup to enable external auditing at agricultural cooperatives.

DGRV owned a valid registration certificate as a official NGO in Vietnam. We signed MOUs with our main partners Ministry of Planning and Investment (MPI) and Vietnam Cooperative Alliance (VCA) which is a seperate department at MPI and allowed to sign MOUs as well. In addition we signed MOUs with our partner provinces.

DGRV Hanoi hired nine local staff members and actually two foreign staff members from Germany to support the vietnamese partners and offer trainings to improve the skills at the ministries at macro-level, all alliance levels at meso-level, as well as, provide trainings and workshops to the cooperatives at micro-level.

2. PURPOSE

To ensure a longterm ownership of the implemented project and knowledge the DGRV office offered to the vietnamese partners, it has to extend the registration certificate in May 2022 again.

In addition to this administrative part a new law for employees was enacted in 2021 which influenced the working contracts with the local staff members as well as service contract

To handle the legal framework the purpose of the advisory service and support should cover these two aspects.

3. DELIVERABLES

Support by all questions to the legal framework which influenced the registration certificate for NGOs.

Review the working contracts of the staff and service contract and to ensure compliance with the new law.

4. WORKING SCHEDULE

Support and Advise during the next month, until the registration certificate is extended for three more years.

Review the working contracts at latest in January 2022.

5. QUALIFICATIONS

• A registered law and advisory company with a valid company registration certificate
• Company located (or with authorized office) in Hanoi, Vietnam
• Minimum 3 years of experience in advisory, support on legal framework of Vietnam
• Experience working with NGOs is a strong plus
• Provide the service at least in English, German would be desirable

6. PRICING

7. SELECTION

• DGRV will determine the suitability of candidates during a technical interview.
• A contract may be awarded to the company representing the best value for money, i.e. the deliverable language, the time of experience, the working experience with other NGOs.
• DGRV reserves the right to accept or reject any quotation, and to cancel the process and reject all quotations at any time before the award of contract without thereby incurring any liability to the suppliers or any obligation to inform the suppliers of the grounds for such action.
