The German Red Cross (GRC) is part of the world wide Red Cross and Red Crescent Movement assisting victims of conflict and disaster and people affected by social or health related crisis. The Red Cross movement provides to vulnerable people assistance without discrimination as to nationality, race, religious beliefs, class or political opinions and adheres to the seven principles of the Red Cross movement: Humanity, Impartiality, Neutrality, Independence, Voluntary Service, Unity and Universality.
In Vietnam GRC is supporting its local partner, the Vietnam Red Cross (VNRC), to implement projects in the field of Disaster Relief & Rehabilitation, Disaster Risk Reduction & Climate Change Adaptation, Water & Sanitation and Capacity Building.
The legal basis for operating in Vietnam is the Certificate of Registration No 66/BNG-VPDA which is currently valid till 05/11/2018.
To enhance the level of compliance with the actual regulations on Personal Income Tax(PIT) for an average of 16 staff membersand Value Added Tax(VAT), GRC is seeking for the services of a Tax Agent who can provide professional support on PIT and VAT issues on a longer term / regular basis.
SCOPE OF SERVICE
Personal Income Tax
- Obtain the information/ documentation from the GRC Office on the employees’ income and remuneration; consultant and other fees.
- Analyze incomes and remunerations of the employees, consultant and other fees under the Vietnamese PIT laws and regulations;
- Prepare and co-sign the PIT declaration and finalization report; submit the draft to GRC for reviewing and approval; send the report to the local tax Authorities.
- Issue PIT payment instructions to the GRC Office to ensure that the payable PIT amount is in accordance with the Government regulation.Clarify any queries of the local tax authority on the figures reported based on the information provided by GRC. Take responsibility for the accuracy and completeness of PIT declaration and finalization report for GRC.
- Ensure the relevant deadlines and the requirement from the Vietnamese Government regarding the PIT for GRC international and local staffs.
- Provide practical advice to GRC referring to the relevant regulation in order to minimize the tax payment for the Organization and to reduce the risks.
- Other task related to PIT to be assigned by German Red Cross.
Value Added Tax
- Obtain the information/ documentation from the GRC Office regarding the procedure of VAT refund or VAT exemption for GRC projects.
- Deal with the relevant Tax Authorities to get their confirmation on the procedure how to refund/exemption VAT for GRC projects.
- Provide guidance on how GRC should apply the procedure of VAT refund/exemption for the projects.
- Prepare and co-sign the VATdeclaration and refund report, submit it to GRC for crosschecking and approval.
- Ensure intime submission of the VAT report to the Government.
- Ensure the deadline and the requirement from the Vietnamese Government regarding the value addedtax refund/ exemption report.
- Other task related to VAT to be assigned by German Red Cross.
WORKING PLAN and CONSULTANT FEE
- The consultant fee for the regular PIT finalization will be based on a “per person” measure (i.e. VND per person / for a PIT monthly / quarterly report, and VND annual PIT finalization / person).
- The consultant fee for the work on VAT will be based on a working plan per hour / per months which has to be agreed with GRC in advance. At a later stage the fee may be recalculated based on an average of X transactions subject to VAT per month.
