Request for Proposal from one International Freelance Consultant or one International Consultant from Firm to Facilitate Legislative Reform for Disaster Risk Management (DRM) in Viet Nam

A three-year UNDP technical assistance (TA) project (until December 2011) entitled: “Strengthening institutional capacity for Disaster Risk Management in Viet Nam, including climate change-related disasters” was approved in September 2008 by the Government of Viet Nam. This project, supported by UNDP funding of US$4.25 million and an in-kind contribution from the Government, will be implemented by the Ministry of Agriculture and Rural Development (MARD) in collaboration with the Provincial People Committees of Binh Thuan, Can Tho and Cao Bang, the Viet Nam Red Cross (VNRC), the Hanoi Water Resources University and other universities and institutes.
The overall TA project supports the objectives of the National Strategy for Disaster Prevention, Response and Mitigation to 2020 and the Action Plan Framework for Adaptation to Climate Change in the Agriculture and Rural Development Sector Period 2008-2020 prepared by MARD, as well as the National Target Program to Respond to Climate Change prepared by Ministry of Natural Resources and the Environment (MoNRE) in consultation with MARD.
Viet Nam already has an array of legislation relating to disaster risk management (DRM), however, it has been recognised that the system has some gaps; remains dispersed, and lacks overall cohesiveness which may limit the ability to carry out efficient and effective DRM. Fortunately, there has been significant action in recent years by the Government and civil society organisations in the area of legislative reform for DRM. Most significantly, the National Strategy for Natural Disaster Prevention, Response and Mitigation to 2020 (2007) has identified a process to develop and promulgate a DRM Law by 2012 through the consolidation of existing laws, policies and mechanisms
This project aims to build on the work already undertaken on legislative issues on DRM in Viet Nam to actively encourage and facilitate legislative reform. In particular it will develop a proposal for the structure and content of the new DRM law and any necessary implementing decrees/regulations. This project will not result in a draft text, but will provide the basis for a future drafting process.
