National Consultant to Conduct a Gendered and Rights-Based Desk Review of Vietnamese Laws, Policies and Regulations Governing International Labour Migration from Viet Nam under UN Women-DOLAB Project on “Empowering Women Migrant Workers in Viet Nam”

UN Women Vietnam is seeking for one National Consultant to conduct a gendered and rights-based desk review of Vietnamese laws, policies and regulations governing international labour migration from Viet Nam under UN Women-DOLAB Project on “Empowering Women Migrant Workers in Viet Nam”

The key tasks to be completed are as follows:
- Meet DOLAB and UN Women for initial discussions to understand the details of the desk review project;
- Review relevant documentation to be provided by DOLAB and UN Women and to be sourced from elsewhere , where relevant; and
- Present and discuss the draft report at four meetings to be organized by DOLAB and UN Women for legal and gender experts from government agencies, mass organizations and local NGOs, UN agencies and donors for improvement and finalization through comments and suggestions; and
- Finalize the draft report and presentation on feedback received from other experts.

DOLAB and UN Women have overall management of the work of the consultant, and she/he will be ultimately responsible to the Director of DOLAB and the UN Women Country Representative in Viet Nam. She/he will be in direct contact with the nominated person of DOLAB and the Programme Officer of UN Women Viet Nam CO and report to them on the work progress on a regular basis for discussion and comments during the consultancy.
The consultant is expected to deliver the final report in English. The desk review should consist of existing laws, policies and regulations related to migration and labour analyzed using the lens of CEDAW and other international standards such as the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, General Recommendation No. 26 on Women Migrant Workers of the United Nations Committee on the Elimination of Discrimination against Women,  with a focus on the protection and promotion of rights of  women migrant workers, with the following sections:

1. The first section to provide a brief description of the female migration for work overseas;
2. The second section to provide the existing laws, policies and regulations in the country on labour and employment, and migration, and to identify their deficiencies from rights-based and gendered perspective;
3. The third section to contain an assessment of those laws, policies and regulations in relation to their compliance with international standards and ASEAN commitments to better protect the rights of women migrant workers; and
4. The fourth section to contain recommendations for compliance through legislative and policy changes.
