USAID Saving Species – Recruitment of consultants on development of the in-depth training materials (ITM) on the provisions in the Penal Code on criminal cases for the protection of endangered, precious and rare wildlife species.

The United States Agency for International Development (USAID) Saving Species Program is USAID/Vietnam’s flagship implementation vehicle for combating wildlife trafficking and implemented by Tetra Tech in partnership with Vietnam CITES Management Authority of the Ministry of Agriculture and Rural Development. TRAFFIC Vietnam and the Wildlife Conservation Society (WCS) are also project partners.

USAID Saving Species is seeking 02 qualified Consultants to develop in-depth training materials (ITM) on the provisions in the Penal Code on criminal cases for the protection of endangered, precious and rare wildlife species. The consultants shall work closely with the Supreme People’s Court (SPC) in Ha Noi with travelling to provinces as requested.

Below is the summary of the Scope of work (SOW); for more details, please refer to the attached SOW.

Overall Goal: To build capacity of the SPC on the Penal Code's provisions related to violations of regulations on protection of wild animals, rare and precious animals and the Resolution of the Judges’ Council of the Supreme People's Court on the application of Article 234 and Article 244 of the Penal Code.

Specific Objective: To develop ITM for judges, investigators and court clerks on legal provisions related to the protection of wildlife, endangered, precious and rare animals.

Main tasks & Responsibilities:

  • Development of the ITM
  • Consultation on the ITM at 3 regions for further development
  • Participate in the Appraisal and approval meeting of ITM for feedback
  • Check ITM design for Printing

Appraisal and approval of ITM

  • 01 meeting report with all feedbacks, recommendations and comments from the Appraisal and approval meeting participants for the ITM revision and finalization.
  • The final draft of the ITM compiled with comments from appraisal board.

  • Report in Vietnamese with 01 page executive summary in English
  • The final draft of ITM in Vietnamese with 03 pages executive summary English

Checking ITM design for publication

  • The design of the approved ITM is checked and signed by SPC for printing

Timeline/Working days:

  • Starting date: 07th March 2019.
  • Ending date: When the ITM is approved by the SPC for publication (expected 31st May, 2019).
  • Total working time for conducting the consultancy work: 80 days (8 hours per day) for 2 consultants.

Qualifications/Criteria:

The consultancy will be conducted by 2 consultants including 01 Consultant on judgment cases with practical experience in judgment - Team leader; and 01 Consultant on legislation and law enforcement – Team member.

Consultant on judgment cases (Team leader)

  • A minimum of 10 years or more working in the judgment area;
  • Experience in policy research, review and assessment;
  • Experience in capacity building including training curriculum development;
  • Experience in working with state management agencies at all levels;
  • Experience and skills in teamwork; ability in analyzing and synthesizing reports, consolidating feedback and responses on policy issues;
  • Excellent presentation and legal document writing skills;
  • Fluency in office computer skills, English and Vietnamese literacy.

Consultant on legislation and law enforcement/legislation (Team member)

  • A minimum of 07 years or more working in legislation, law enforcement and/or judgment area or relevant fields;
  • Experience in policy research, review and assessment;
  • Experience in capacity building including training curriculum development;
  • Experience in working with state management agencies at all levels;
  • Experience and skills in teamwork; ability in analyzing and synthesizing reports, consolidating feedback and responses on policy issues;
  • Excellent presentation and legal document writing skills;
  • Fluency in office computer skills, English and Vietnamese literacy.
